The Federal Communications Commission's Enforcement Bureau has commenced its 2025 Equal Employment Opportunity (EEO) audits, selecting approximately five percent of radio stations for review of their adherence to federal EEO regulations. This selection process followed a public notice issued on August 8.
Amidst these audits, the National Association of Broadcasters (NAB) has reiterated its stance against EEO audits, advocating for their discontinuation. In a recent submission under the FCC's 'Delete, Delete, Delete' initiative, the NAB argued that these audits are ineffective and excessively burdensome for broadcasters.
Radio stations chosen for the 2025 audit are required to submit their EEO compliance documentation to the FCC's online public inspection file by September 22. The FCC website offers a template of the audit letter and the complete EEO rules for guidance.
Unlike previous years, completion letters will not be issued by the Enforcement Bureau post-audit. Stations will only be contacted if further clarifications are needed or additional documentation is warranted during the assessment.
Failure to adhere to the audit procedures or furnish requested materials can lead to FCC enforcement measures. Penalties for non-compliance vary from monetary fines to license revocation or denial of renewal, contingent on the violation's gravity and the station's compliance track record.
In certain instances, audited stations may need to implement new EEO policies or protocols and could face heightened compliance scrutiny going forward.
